Conditions
                                                                  Effective Date: February 1, 2025

Welcome to Cadencia. Your trust is important to us. These Terms & Conditions explain the terms governing your use of the Cadencia website, online resources, community spaces, and related services.

By accessing or using this website, submitting information through our forms, registering for a course or workshop, participating in a Cadencia community space, or otherwise engaging with Cadencia's online content, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
If you do not agree with these Terms, please do not use this website or its resources.

1. About Cadencia

Cadencia is a professional mental health practice and community resource founded and operated by Alyssa Anna-Marie Nazario Berry, LCSW.
Professional services are provided only within the scope of applicable law and within jurisdictions in which the clinician providing services is appropriately licensed or otherwise authorized to practice.

Cadencia currently maintains professional licensure in:
Colorado — Licensed Clinical Social Worker (LCSW)
Texas — Licensed Clinical Social Worker (LCSW)

Professional licensure and authorization to practice may vary by service, location, clinician, and applicable law.

2. Website and Educational Disclaimer

Information published on the Cadencia website, including articles, blog posts, videos, worksheets, community resources, educational materials, social media content, and other resources, is provided for general educational and informational purposes only.

Website content is not therapy, psychotherapy, diagnosis, treatment, medical advice, legal advice, or individualized professional advice.
Reading, downloading, submitting a form through, or otherwise interacting with information on this website does not create a therapist-client relationship.

Do not rely on website content as a substitute for professional evaluation or treatment appropriate to your individual circumstances.
If you are experiencing an emergency or believe that you or another person is in immediate danger, call 911 or contact the 988 Suicide & Crisis Lifeline. Website forms, email, and other electronic communications should not be used for emergencies.

3. No Therapist-Client Relationship Through Website Use

Your use of this website, submission of a contact form, consultation request, inquiry, email, or other communication does not by itself establish a therapist-client relationship with Cadencia or any clinician affiliated with Cadencia.

A professional relationship is established only through the applicable intake, consent, and service procedures required by Cadencia and applicable law.
Submitting information through this website also does not guarantee that Cadencia will be able to provide services, accept you as a client, or respond within a particular timeframe.

4. Service Location and Professional Boundaries

Mental health services are provided only to individuals who are physically located in a jurisdiction where the clinician providing the service is legally authorized to practice at the time services are rendered.

Because laws governing telehealth and the practice of social work vary by jurisdiction, Cadencia may be required to verify your physical location before or during a telehealth appointment.

You are responsible for providing accurate information regarding your physical location when receiving telehealth services.
Cadencia may decline, discontinue, or refer services when providing care would fall outside applicable licensure, jurisdictional, ethical, or legal requirements.

5. Telehealth and Electronic Communication

When services are provided through telehealth, additional terms, informed consent requirements, privacy practices, and technology policies may apply.
Electronic communication, including email, website forms, scheduling platforms, and messaging systems, may not be monitored continuously.
Cadencia does not guarantee that electronic communication will be received, reviewed, or answered immediately.

Do not use email, website forms, messaging systems, or other electronic communication for emergencies or urgent clinical needs.

6. Privacy and Confidentiality

Cadencia takes privacy seriously.

Information submitted through this website may be collected, used, stored, or disclosed as described in Cadencia's applicable privacy policies and notices.
Website privacy practices are separate from the confidentiality protections that apply to established clinical relationships.

Information submitted through a website contact form, consultation request, registration form, or similar resource should not be assumed to have the same protections or limitations as information disclosed within an established clinical relationship.

For clients receiving clinical services, confidentiality and privacy are governed by applicable federal and state law, professional ethical requirements, informed consent documents, and Cadencia's applicable Notice of Privacy Practices and other clinical documentation.

7. Forms, Consultations, and Intake Information

Website forms and consultation requests are intended to help Cadencia determine whether a requested service may be appropriate.

Submission of a form does not guarantee acceptance as a client, availability of services, or the establishment of a therapeutic relationship.
You agree to provide information that is accurate and reasonably complete when submitting forms or requesting services.

Cadencia may request additional information when reasonably necessary to determine eligibility, appropriateness, scheduling, jurisdiction, or other requirements related to services.

8. Payments, Fees, Refunds, and Cancellations

Fees, payment requirements, cancellation policies, refund policies, and other financial terms applicable to therapy, courses, workshops, supervision, trainings, or other services will be provided at the time of registration, scheduling, purchase, or engagement.

By purchasing or registering for a service, you agree to the financial terms presented for that specific service.

Where a separate written agreement, informed consent document, service agreement, course agreement, or cancellation policy applies, that agreement will govern the applicable service.

Nothing in these Terms is intended to modify an existing clinical, contractual, insurance, or informed-consent agreement.

9. Community Resources and Community Guidelines

Cadencia may provide community spaces, educational hubs, groups, discussion areas, courses, or other community resources, including the E4C Hub.
Participation in Cadencia community spaces requires respectful and appropriate conduct.

Cadencia reserves the right to remove content, restrict participation, suspend access, or terminate participation when reasonably necessary to protect the community, its users, or Cadencia's legal and professional obligations.

Community participation does not create a therapist-client relationship unless a separate professional relationship has been formally established.

This website may contain links to third-party websites, organizations, services, educational materials, or other resources.
These links are provided for convenience and informational purposes.

You may use materials provided for personal educational purposes only, unless a different license or written permission is expressly provided.

12. Accuracy of Information

15. Limitation of Liability

To the fullest extent permitted by applicable law, Cadencia and its owners, clinicians, contractors, and representatives will not be liable for indirect, incidental, consequential, special, or other damages arising from or related to your use of, or inability to use, this website or its general educational content.

Nothing in these Terms is intended to waive or limit rights or protections that cannot lawfully be waived or limited.

16. Governing Law

These Terms & Conditions concerning the use of the Cadencia website are governed by the laws of the State of Colorado and Texas, without regard to conflict-of-law principles, except to the extent that applicable federal or state law requires otherwise.

Nothing in this section is intended to determine which state's laws govern the provision of professional mental health services to an individual client.

Clinical services provided by Cadencia are subject to the laws, regulations, licensing requirements, professional standards, and other applicable requirements of the jurisdiction in which the services are provided, including applicable federal law.

17. Changes to These Terms

Cadencia may update these Terms & Conditions from time to time to reflect changes in services, technology, business practices, or applicable laws and regulations.
When changes are made, the updated version will be posted on this page with a revised effective date.

Your continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.

18. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms & Conditions govern your general use of the Cadencia website.

They do not replace or supersede any separate informed consent, clinical services agreement, Notice of Privacy Practices, payment agreement, course agreement, community agreement, or other written agreement that applies to a specific Cadencia service or relationship.

Where a separate agreement applies, that agreement will govern the specific subject matter addressed by that agreement.
